1. What is an Affiliate Program?

In general terms, an Affiliate Program is a way to generate revenue by referring customers to a merchant website. Each time a customer you refer makes a purchase, you earn a commission. You may refer people to the site using a link that has your affiliate code in it, or via e-mail and print using your affiliate code. At TutorialsUnlimited.com, each customer you send to us will generate a commission of 33% of the monthly subscription, month after month for the life of the account!

2. What does it cost to join?

It is absolutely free to join. There are no minimum sales requirements and you can cancel at any time. We are here to help, but we won't bug you or spam you. In other words, you choose how much or how little you promote our programs.

3. How does it benefit my site?

Visitors to your site will appreciate the quality of products and services you refer. For example, if you refer people who sign up for the Twitter Tutorials, they will always think of you as they benefit from their subscription.

4. How do I create these links?

You will receive a link to a special affiliate tools page with predesigned banners and text links. Simply copy the code provided and paste into your site. It's that easy.

5. Can I refer people through my printed newsletter or event handouts?

Certainly! Simply place within the referral text a note asking them to use the link you provide. Or, you can refer them to the page on your site that includes your affiliate link. Something like, "go to www.mysite.com and click on the TutorialsUnlimited.com banner at the top" would work great! 6. How often do I receive commissions?

Commissions are paid immediately to your PayPal account when one of your referral's signs up.

7. What about charge-backs, fraud and refunds?

Customers will be required to use PayPal to order or subscribe. In the event the charges are disputed or fraudulent, your account will be debited for the amount of commission earned on that transaction. This is all handled automatically via PayPal.

8. What is a subaffiliate?

As a reward for promoting our affiliate program, we pay commissions on the sales of affiliates that you refer to us. So, if you refer Bob to our affliate program, and he signs up with the link you provide, you'll receive a 7% commission from every sale Bob refers, while Bob receives his full 33% commission. The 7% commission is called an override.

9. Is my site eligible to become an Affiliate?

Although most sites qualify to become affiliates, we do reserve the right to reject or cancel the affiliate account of any site we feel contains objectionable material. This would include (but is not limited to) sites with violent/hate speech, extreme pornography, or illegal content, as well as parasite affiliate sites (if you don't know what a parasite is, then you're not one!).

10. How do I know I will be paid for my referral?

Each time one of your referrals arrives at our site through your unique affiliate URL, our system places a cookie on the user's computer. When the customer completes their subscription, the system checks for the referral cookie. The process is automatic and designed to ensure accurate tracking. The cookie remains in the computer for life after the first visit through your affiliate URL, so you'll still receive commissions from customers who don't purchase on their first visit, but return later, even if they go directly to our site.

11. What is a parasite?

Parasites are malicious applications similar to adware and spyware that can result in commission theft. Any affiliate found to be using parasitic methods will be terminated and commissions will be revoked. Additionally, any use of spam to promote TutorialsUnlimited.com will result in account termination and commissions recinded.

12. What kind of help do you provide?

We will provide you with the tools and assistance you'll need to optimize your valuable site space. We will support you every step of the way. We have graphical banners, screen shots, sample tutorials, text links, article ideas, and emails that you can use. From time to time we will provide affiliate-exclusive discounts and promotions to help you get those almost-ready customers to commit to a purchase.

To be an authorized affiliate of TutorialsUnlimited.com, you agree to abide by the terms and conditions contained in this agreement.

The TutorialsUnlimited.com Affiliate Program available through and described herein, as may be modified by TutorialsUnlimited.com from time to time (the "Program"), is owned and operated by TutorialsUnlimited.com, an Indiana business, and is offered to you under the following terms and conditions:

1. Program Enrollment: TutorialsUnlimited.com reserves the right to reject any affiliate application at its sole discretion for any reason.

2. Links. During the term of your affiliation, TutorialsUnlimited.com grants you a non-exclusive, revocable license to (i) display, prominently on your web site as identified in the Program application form TutorialsUnlimited.com's graphic banners or text links and (ii) establish electronic links between your site and TutorialsUnlimited.com's web sites using these links. It is your responsibility to install and format all links properly in accordance with the instructions provided by TutorialsUnlimited.com. TutorialsUnlimited.com may, at its discretion, assist you in installing or formatting the links. You may not in any way modify provided graphics or banners or alter their size. TutorialsUnlimited.com reserves the right to modify the graphics at its sole discretion and you agree to update the graphics on your site within five (5) business days of receiving notice of any such modification. You shall, upon termination of this Agreement for any reason, immediately cease all use of the graphics and links and remove them from your site. Use of the TutorialsUnlimited.com trademarks hereunder and any associated goodwill shall inure solely to TutorialsUnlimited.com.

3. Commissions and Payment Schedule. Commissions are paid immediately via PayPal upon each sale.Within ten (10) days after the end of each calendar month during the term of this Agreement, TutorialsUnlimited.com agrees to pay you the agreed upon percentage of the Transaction Revenues (as defined below) on sales received by TutorialsUnlimited.com during that month. "Transaction Revenues" shall mean amounts received by TutorialsUnlimited.com for purchases by customers arriving from a link on your site tracked by TutorialsUnlimited.com (each a "Transaction"), reduced by (i) shipping and handling charges, taxes, processing fees and similar charges, and (ii) returns, bad credit, credit card fraud, and any credits and allowances issued by TutorialsUnlimited.com to customers; provided, however, that no payment shall be made for any given month for which the affiliate fees owed to you under this section are less than twenty-five dollars ($25.00); in that event, all fees payable shall be carried over to successive months and paid upon the earlier of (x) such time as the cumulative fees payable to you equal or exceed the amount above and (y) TutorialsUnlimited.com's or your termination of your enrollment in this Affiliate Program. Tracking of Transactions requires and is dependent upon the proper installation and formatting of the links on your site in accordance with the provided instructions. TutorialsUnlimited.com will provide you with password protected online access to your transaction histories, which you agree to keep such password confidential and not to disclose it to any third party or allow any third party to use it.

4. Warranties; Indemnity. You warrant to TutorialsUnlimited.com that your site does not and will not promote any illegal activity or discrimination based on race, sex, religion, sexual orientation or physical disability. You agree to defend, indemnify and hold TutorialsUnlimited.com harmless (including for attorneys' fees and court costs) against any claims, actions or demands arising out of any breach of the foregoing warranty.

5. Special Offers. You agree not to post any special offers or coupon codes available at TutorialsUnlimited.com on your site other than those specifically provided to you as part of the Program.

6. Termination. Either party may terminate this Agreement at any time. Upon termination for any reason, TutorialsUnlimited.com shall have the right to withhold final payment hereunder to ensure proper computation of any deductions for returns, bad credit, credit card fraud, and any credits and allowances issued to customers following such termination. Sections 5 through 7 of this Agreement shall survive termination of this Agreement.

7. Warranty Disclaimer. TUTORIALSUNLIMITED.COM MAKES NO WARRANTIES WITH RESPECT TO THE PROGRAM, THE TUTORIALSUNLIMITED.COM WEB SITES, OR THE NUMBER OF TRANSACTIONS GENERATED THROUGH THE PROGRAM, AND HEREBY DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

8. Limitation of Liability. NOTWITHSTANDING ANYTHING IN THIS AGREEMENT TO THE CONTRARY, EXCEPT FOR BODILY INJURY, TUTORIALSUNLIMITED.COM, WILL NOT BE LIABLE WITH RESPECT TO THE SUBJECT MATTER OF THIS AGREEMENT UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHER LEGAL OR EQUITABLE THEORY (I) FOR ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES; OR (II) IN ANY CASE, FOR ANY AMOUNTS IN EXCESS, IN THE AGGREGATE, OF THE COMMISSIONS PAID TO YOU HEREUNDER DURING THE SIX MONTH PERIOD PRIOR TO THE DATE ANY ALLEGED CAUSE OF ACTION AROSE. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION AND EXCLUSIONS MAY NOT APPLY TO YOU.

9. General. TutorialsUnlimited.com reserves the right to modify or cancel the Program or any aspect thereof, by providing you with e-mail notice or notice on the Program web page on the TutorialsUnlimited.com web site. You shall be responsible for noting any such changes. After ten (10) business days' notice of such changes, you will be deemed to accept such changes. You will make no public announcement or press release regarding the relationship entered into hereunder without the prior written approval of TutorialsUnlimited.com. TutorialsUnlimited.com may use your trademarks and logos for identification purposes in its marketing material and press releases. Except as otherwise set forth herein, all notices under this Agreement shall be in writing and shall be deemed to have been duly given when receipt is electronically confirmed, if transmitted by facsimile or e-mail, or upon receipt, if sent by certified or registered mail, return receipt requested. You may not assign or transfer any rights or obligations under this Agreement without the prior written approval of TutorialsUnlimited.com, and any attempt to do so shall be void and without effect. TutorialsUnlimited.com may assign this Agreement in whole or in part. TutorialsUnlimited.com will not be responsible for any delay in the performance of its obligations hereunder caused by any acts, omissions, or events beyond the control of TutorialsUnlimited.com. This Agreement represents the complete agreement and understanding between you and TutorialsUnlimited.com with respect to the subject matter herein, and supersedes any other written or oral agreement. The invalidity or unenforceability of any provision of this Agreement shall not affect the enforceability or validity of any other provision. This Agreement shall be governed by the laws of the State of Indiana, without regard to conflicts of laws provisions thereof. You agree and consent to the sole jurisdiction and venue for actions related to this Agreement shall be the state and federal courts located in Hamilton County, Indiana.
